Debt Recovery

Douros Jackson undertakes Litigation in all states and territories of Australia, Douros Jackson has a very accomplished debt recovery practice, from the issuing of letters of demand, through to issue of proceedings and obtaining judgement. We also explore all options post judgment to maximize recovery, including the issuing of garnishees, examinations and/or bankruptcy/winding up proceedings.

Douros Jackson also has a department that deals with the obtaining of Court Orders for repossession pursuant to the National Consumer Credit Code, across Australia.

Douros Jackson has extensive experience in all aspects of debt recovery including commercial, consumer and wholesale. We specialise in the provision of debt recovery services to commercial financiers and have developed systems and practices to enable the provision of these services in a cost effective, successful and time efficient manner.

We have established a solid reputation as a market leader for our efficient and commercial approach to debt recovery with a view to achieving a result for our clients. For example, with debt recoveries, we review all files to establish and determine the prospects for recovery and the commercial viability of expending client funds in the litigation process. This review is monitored and discussed with our clients to maximise recoveries per dollar of legal costs incurred.

We can handle multiple recovery actions on behalf of any particular client and provide regular reporting of progress on all files.

Litigation

Litigation in all jurisdictions of Australia.

Douros Jackson acts for a variety of major corporate clients in their litigation needs including contract disputes, shareholder disputes, copyright infringements etc. Litigation can be a very costly and time consuming exercise for the participants. We work hard in trying to maximise the results as cost effectively and time efficiently as possible.

We work closely with a team of barristers who provide to us excellent advice in a timely and cost effective manner. We have negotiated excellent rates with our barristers and our litigation team understands the “ins and outs” of the Court system.

  • Acting for a large financier in all aspects of their debt recoveries Australia wide. This involves commencement of proceedings, negotiations, judgements and enforcement of judgements through both Bankruptcy and Liquidation proceedings.
  • Acting for insolvency practitioners to assist in their debt recoveries, legislative requirements, preferential claims, fraud, Competition and Consumer Act and Fair Trading Acts,

Douros Jackson, through its partners Peter Douros and Sarina Jackson, has extensive experience in handling major commercial property transactions, leasing and tenancy disputes. We have a thorough understanding of the requirements for conducting successful transactions of this nature.

We draft and negotiate commercial leases. We understand the law relating to tenancies with a view to avoiding disputes. If a dispute does arise, we have the experience to deal with the litigation to achieve the optimum result for our clients.

Douros Jackson acts for many property developers and investors. We can assist in every aspect of multi-unit developments, “off the plan” sales and subdivisions generally.

We advise on all aspects of property sales and acquisitions. We conduct all searches and due diligence, prepare and/or review contracts for single and multi-lot developments.

We can assist in all aspects of financing such transactions having a thorough understanding of lenders requirements.

Family

PPSA

  • Advising clients on all aspects of the Personal Properties Security Act 2009 (Cth) (PPSA) and Personal Properties Security Regulations 2010 (Cth)
  • Advising clients on disputes stemming from competing PPSA interests
  • Specific advice in relation to PPSA security interest registrations, including the drafting of financing statements, establishing company procedures for client staff to ensure the proper registration of security interests to avoid defective registrations, advising on changes to registrations and financing statements following changes in the nature of client security interests or contractual arrangements with customers.
  • Acting for clients, in relation to a PPSA priority disputes. The provision of advice on the attachment and perfection of security interests, transitional security interests and temporary perfection, purchase money security interests (PMSIs), and “taking free” provisions

Specifically, we undertake work in connection with start-up or first/second round funding for new business, technology, e-commerce, software and telecommunications companies including due diligence, establishment of deal parameters, Subscription Agreements (ordinary and preferred shares), Shareholder Agreements, Executive Service Agreements, Employee Share Options Schemes, ASIC compliance etc.
